Abstract
:
Having knowledge of the verses on rulings has a great benefit for the jurisprudential researcher. It is the way towards knowing and understanding Allah’s Law. From them we know what is lawful and what is unlawful. To look into them in order to deduce the rulings from them is worthy of attention because of its impact on building the jurisprudential mentality. From this perspective comes my choice of this thesis, which is part of a blessed project to study the topic of ‘Understanding the verses on rulings in Imam Al-Nawwawi’s book ‘Al-Majmoue’. My share is about the verses on rulings from Chapter (Attawbah-Repentance) to Chapter (Al-Nahl-The Bee). I have made a comparative jurisprudential study of the rulings among the four schools of jurisprudence, with reference to the approved books in each school. The study is divided into an introduction, and two chapters, followed by indexes. Chapter One is dedicated to introducing the verses on rulings, their origin and the most important books on them, in addition to introducing Imam Al-Nawawi and his book (Al-Majmoue). Chapter Two includes the verses on rulings mentioned in (Al-Majmoue), from chapter Attawbah to chapter Al-Nahl. The number of questions deduced from these verses is 24 questions which are varied to include chapters on purification, prayer, Zakat. . . etc. I have reached several conclusions among which are: The science of the verses on rulings is not a new one; it existed during the Prophet’s time (PBUH) and his companions’, though the terms were different. Besides, Al-Nawawi’s book (Al-Majmoue) is not just a book of jurisprudence; rather, it is a comprehensive encyclopedia of many arts, and the jurisprudential rulings are consequential on each other in the sense that a question might give a ruling based on the ruling of another question, or by analogy. In addition, the differences among the jurists might be attributed to their difference in understanding the texts or in judging hadiths. Therefore, I recommend that fellow researchers and educators should link the verses on rulings to our contemporary reality, facilitating their understanding to the youths so that a generation would be brought up that knows the rules of its Lord, showing high regard to the religious texts and rulings
