Praise to Allah, Lord of the Worlds and peace be upon our Prophet Mohammed with colleagues, Recognizing of jurisprudential rules of domestic labors is most important subject which serves a large segment in society, with the frequent need for recruiting them, spread of ignorance among this segment people, increasing of disputes and conflicts in their subjects. So, there was urgent need to study their rules through Jurisprudential research titled "Jurisprudential Rules of domestic Labors (Acts of worship, Transactions, and jurisprudence of the family)". Approach of the study is documentary approach, through hiring the Jurists books, studying their rules by using comparison method between the most four famous Jurisprudential schools. Using work list of domestic labors in the kingdom of Saudi Arabia to confirm & show the rules which have been studied. – If any. The research consists of introduction, five chapters, and conclusion. 1st Chapter: The reality and legitimacy of domestic labors, jurisprudential coordination of domestic labors contract. 2nd Chapter: The jurisprudential rules that related to religious and gender among domestic labor and the employer, through two sections, 1st section is jurisprudential rules of religious, 2nd section is jurisprudential rules of gender. 3rd Chapter: The jurisprudential rules that related to acts of worship, through four sections, 1st section is about Prayer and Fasting, 2nd section is about Funerals, 3rd section is about Zakat and Alms, 4th section is about Hajj and Umrah. 4th Chapter: The jurisprudential rules that related transactions, through four sections, 1st section is about Contracts, 2nd section is about Wages, 3rd section is about Guarantee, 4th section is about Qafalah. 5th Chapter: The jurisprudential rules that related to jurisprudence of family, decorations and dress, through two sections, 1st section is about jurisprudence of family, 2nd section is about decorations and dress. The study has some results, the most important results are: the domestic labors rules issued due to leasing rules in Islamic jurisprudence, show the care of Islam for the domestic labors by rules which protect their rights, and explain their duties toward employers overall. This research concluded with appendixes that accepted in dissertations, and recommendations. |
